3. How We Use Your Information
- To respond to inquiries and quote requests and to provide our manufacturing services;
- To evaluate employment applications and communicate with applicants;
- To operate, maintain, analyze, and improve the Site;
- To protect the Site against spam, fraud, and security threats;
- To comply with legal obligations and enforce our rights; and
- For other purposes with your consent.
4. Cookies
When you first visit the Site, a cookie banner lets you accept or reject non-essential cookies, or choose them by category (for example analytics and functional). Strictly necessary cookies, such as security cookies set by Cloudflare and Wordfence and the cookie that stores your consent choice, are always active because the Site needs them to work. Analytics cookies (Google Analytics) and functional cookies (such as Tidio chat) are set only if you agree. You can change your choice at any time with the “Cookie Settings” link in the Site footer. You can also use the “Do Not Sell or Share My Personal Information” link in the footer. You can also block or delete cookies in your browser settings, though some features may not work properly.
The Site honors the Global Privacy Control (GPC) signal. If your browser sends GPC, we treat it as a request to opt out of the sale or sharing of personal information for that browser.
5. How We Share Your Information
We do not sell your personal information for money. We may share information:
- With service providers that perform services for us, such as those listed in Section 2, hosting, and email;
- With law enforcement, regulators, or others when required by law or legal process, or to protect our rights, property, or safety or that of others;
- In connection with a merger, acquisition, restructuring, or sale of assets; and
- With your consent or at your direction.
We may share aggregated or de-identified information that cannot reasonably be used to identify you.
Allowing analytics cookies (such as Google Analytics) may be considered “sharing” for cross-context behavioral advertising, or a “sale,” under some state laws. You can opt out by rejecting analytics cookies in the cookie banner or by using GPC.
Sensitive Personal Information
Our employment application collects date of birth and criminal history. We use this information only to evaluate your application, verify eligibility, carry out lawful background checks, and meet legal obligations. Criminal history is considered only as permitted by applicable fair-chance and anti-discrimination laws. We never use this information for marketing or analytics, and we never sell or share it.
6. Data Retention
We keep personal information only as long as reasonably necessary for the purposes described above, including to meet legal, accounting, and reporting requirements. As a general guide:
- Contact, quote, and other form submissions: up to 5 years.
- Employment applications: up to 5 years, or longer if applicable employment record-keeping laws require it.
- Analytics data: according to the retention settings of the analytics tool (Google Analytics event data is kept for 14 months).
- Security logs: for a limited period as needed to protect the Site.
7. Your Choices
You may choose not to give us certain information, though this may limit your ability to use some features. You can manage cookies through the cookie banner and your browser. You may unsubscribe from marketing emails at any time using the link in the email.
8. Your California Privacy Rights (CCPA/CPRA)
If you live in California, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the following rights:
- Right to know: request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclose it to.
- Right to delete: request that we delete personal information we collected from you, subject to certain exceptions.
- Right to correct: request that we correct inaccurate personal information.
- Right to opt out of sale or sharing: opt out of the “sale” or “sharing” of your personal information. You can do this by clicking the “Do Not Sell or Share My Personal Information” link in the Site footer, by rejecting non-essential cookies in the cookie banner, by enabling Global Privacy Control in your browser, or by contacting us.
- Right to limit use of sensitive personal information: we collect sensitive personal information only from job applicants (date of birth and criminal history). We use it only to evaluate applications and for employment purposes, as permitted under CPRA regulations (Cal. Code Regs. tit. 11, § 7027(m)). We do not use or disclose it to infer characteristics about you, and we do not sell or share it. Because we limit our use this way, we do not offer a separate “Limit the Use of My Sensitive Personal Information” link.
- Right to non-discrimination: we will not discriminate against you for exercising any of these rights.
Categories collected in the past 12 months: identifiers (name, email, phone, IP address); sensitive personal information (date of birth and criminal history, from job applicants only); professional or employment-related information (for applicants); internet or network activity (usage data); approximate geolocation; and the contents of your messages and uploaded files. Sources: you directly, your device, and our service providers. These categories are used and disclosed for the purposes in Sections 3 and 5. We do not knowingly sell or share the personal information of consumers under 16.
Job applicants: California residents who apply for jobs have the rights above for the personal information collected through the application.
How to submit a request: email us at [email protected] or call us at (906) 932-5970. We will verify your identity by matching information you provide with information we have. You may use an authorized agent, and we may ask for proof of the agent’s authority. We will respond within 45 days, as the law requires.
9. Other U.S. State Privacy Rights
Residents of certain other states, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others with comprehensive privacy laws, may have similar rights. These can include the right to confirm whether we process your personal data, to access, correct, delete, and get a portable copy of it, and to opt out of targeted advertising, sale, or profiling. To use these rights, contact us as described in Section 15. If we deny your request, you may appeal by replying to our decision with the subject line “Privacy Appeal.” If your appeal is denied, you may contact your state Attorney General.
10. Visitors from the European Economic Area, UK, and Switzerland (GDPR)
If you are in the EEA, the United Kingdom, or Switzerland, Burton EMS is the controller of your personal data. We process your data on these legal bases:
- Consent: for analytics and functional cookies, and for live chat cookies. You can withdraw consent at any time through the cookie banner;
- Contract / pre-contractual steps: to respond to quote requests and provide services;
- Legitimate interests: to operate and secure the Site, prevent spam (reCAPTCHA), and respond to inquiries; and
- Legal obligation: to comply with applicable laws.
You have the right to access, correct, erase, restrict, or object to processing of your personal data, the right to data portability, the right to withdraw consent, and the right to lodge a complaint with your local data protection authority.
International transfers: we are based in the United States, and your information will be processed in the United States and other countries where our service providers operate. Where required, we rely on appropriate safeguards such as the EU-U.S. Data Privacy Framework or Standard Contractual Clauses used by our providers.
11. Children’s Privacy
The Site is not intended for children under 13 (or under 16 in the EEA), and we do not knowingly collect personal information from them. If we learn that we have collected such information, we will delete it promptly. If you believe a child has provided us with personal information, please contact us at [email protected].
12. Security
We take reasonable administrative, technical, and physical measures to protect your information. These include encrypted (HTTPS) connections, Cloudflare security services, a Wordfence web application firewall, and restricted administrative access. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13. Links to Other Websites
The Site may link to third-party websites and services that we do not control. We are not responsible for their privacy practices. Please review their privacy policies before providing any information.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The Effective Date at the top shows when it was last revised. If we make material changes, we will provide notice on the Site.
